Farts and Coke Bumps: Outlaw Dave Lawsuit Turns Even Uglier

Affidavits filed in Houston lawyer James Walker's breach of contract lawsuit against radio personality "Outlaw" Dave Andrews accuse Walker of openly abusing drugs and threatening a business partner.

Walker -- you may know him as "Walker: Texas Lawyer" -- sued Andrews and Duane Bradley after the co-owners of Outlaw Dave's Worldwide Headquarters allegedly squandered Walker's $360,000 loan for the business.

In an August 15 affidavit, Bradley accused Walker of coming to his home and said of Bradley's and Andrews's attorney, Scott McLemore, "The last time a lawyer made me this mad it was 1996 and he is still breathing through a straw out of his neck."

Among Walker's other alleged colorful comments were "I decided weeks ago that if I don't get what I want, then I will put the bar out of business....No one farts in that bar that I don't know about it."

In an affidavit sworn five days later, the improbably named Slade Ham -- apparently part of Andrews's show -- alleged that "Over the last year...Jim Walker's actions became quite questionable and disturbing, in that his use of painkillers increased dramatically. While Jim Walker had recreationally used painkillers the entire time I'd been around him, he'd never done so in as reckless and concerning a fashion. Walker referred to painkillers as 'vitamins,' offering them to others and me as another might offer Tic-Tacs."

In yet another affidavit, a fellow named Mike Mealy alleges that Walker offered him cocaine after a broadcast of Andrews's show in Galveston in 2011: "Attorney Jim Walker got into his vehicle and beckoned me inside the car, where he then produced a small bag of what he asserted to be cocaine, and offered me some. I then observed Attorney Jim Walker snorting the white powder from the end of a key into his nose, while sitting inside his vehicle."

Walker told Hair Balls that the affidavits were false and defamatory. Walker's original complaint accused Andrews of using drugs in the bar, but was vague on details -- something that is obviously not a problem among Andrews's camp.

Word through the grapevine is that Outlaw Dave's HQ has filed for bankruptcy.  Any reporting on this craig?

@craig.malisow @tshiva77055  I am fairly certain a lawyer (in this case Outlaw Dave's attorney) cannot file affidavits with the court in their pleadings. Otherwise do you not think Walker's side would have done the same? I think the plaintiff in this case has been a lawyer for a long time, so he should/would know better than to go to court without any witnesses, affidavits, or evidence. If Walker has witnesses, affidavits or evidence why is that not part of the public record too or was it just not reported in this story? Is it the authors belief that Walker has no evidence or is this article an attempt to fish for more information? This is unclear to me. Did the defendants file affidavits publicly to smear Jim Walker? May be a good question to explore.

@kamifernandez87 Yep -- the defendants filed a notice of removal to federal court and a petition for chapter 11 relief. A conference is scheduled Oct. 17, so I should have an update soon.

@nickmau5 @craig.malisow @tshiva77055 I'm not sure what you mean by "a lawyer...cannot file affidavits with the court in their pleadings." There's nothing special about affidavits; they're part of a case's public records. 

I did not see any similar affidavits from Walker's camp -- as a matter of fact, the first story (linked to in this one) called Walker's allegations "vague" for that reason: unlike the specifics in the affidavits filed on the defendants' behalf, Walker just referred generally to drug use in his petition.

@tshiva77055 Just to clarify, Outlaw Dave's lawyer didn't make the affidavits public -- they're public record, period, and available for anyone to see.

@mbryanmiller Yeah, they're one-sided because only one side is talking and filing documents of note. It's one of the drawbacks of the "no comment" route. And, as a reporter, it's not my place to publicly challenge people to submit to drug testing. I only ask people I write about to submit to tests involving quadratic equations and polynomials, because I like to make sure my sources are up on their algebra.

@craig.malisow @nickmau5 @tshiva77055 Actually, Walker has plenty of affidavits, witnesses (whom were reliable friends of the defendants I might add), and evidence that is in the public records. Why they are not in this story, I DON"T KNOW! This story is very one-sided and the person who wrote it either (a) doesn't really do good research or (b) is being payed by the defendants. Other than Walker's Petition, his reason for being "vague" or "not wanting to make any comments" is probably due to the fact that he's probably trying to be the bigger person in this mess. That's pretty obvious and I'm sure other people who are smart can figure that out as well.

@brokengstring @tshiva77055 this last comment was obviously written by Slade Ham himself. I saw Slade Ham perform in the past and he is not funny AT ALL!!!!! Just so you know I'm telling the truth, his story about beating up a midget is ridiculous. If that story was true, then it's the only fight he's ever won.

@craig.malisow I do think that it is worth noting that Walker took a hair follicle drug test that shows all negative results back past when the suit was filed.  Will you be printing that.  I read the articles again and your bias goes WAY beyond a non-responsive other side.  Dave and his group of degenerates go further than a simple drug culture, their lives revolve around hard narcotics and chronic alcoholism.  Hair follicle drug tests not only shows positive and negative but also shows the amount of use.  Headline:  "Former show member challenges Dave Andrews and Duane Bradley to take a hair follicle drug test, put up or shut up.  You can include Slade Ham and Mike Mealy as well.  I'll get rich from the betting action.
