Darque Tan Settles with AG over False Claims That Tanning Is Healthy

With people so worried about skin cancer that they're looking for triple-digit SPFs, it takes guts to claim that spending time in a tanning bed is healthy. Orange-y, unnaturally colored guts.

But Houston Darque Tans have apparently continued to say their beds increase Vitamin D in their GTL customers, much to the displeasure of Texas Attorney General Greg Abbott. He went after some Darque Tans in 2008, and today he announced the end of another enforcement action.

"According to an investigation and referral by the Texas Department of State Health Services, Houston-based Darque Tan deployed an advertising campaign that improperly claimed that customers at its 60 indoor tanning facilities would benefit from increased Vitamin D levels -- which the company said would reduce cancer risks," the AG's office said.

"Reduce cancer risks"? Like we say, they've got guts. "Specifically, Darque Tan's online videos and advertising material boasted of its tanning beds' capacity to 'deliver' elevated Vitamin D levels to the body," the AG's office said. "Darque Tan also included videos on its Web site that linked ultraviolet light with a decreased risk of breast cancer."

The settlement calls for Darque Tan to make no further health-related claims and to pay $88,000 in civil penalties and $45,000 in attorneys' fees.
