Brian Culwell, Former Gold and Silver Buyers CEO, Sues Man for Calling Him a Rapist

Brian Edgar Culwell, the subject of a Houston Press expose last year, is back in court. A frequent defendant in criminal cases over the years, Culwell, whose family operates the precious-metal buyers with the ubiquitous "We Love Gold Diggers" billboards, is a plaintiff this time around.

In a suit filed on August 24, Culwell claims an area man named Norman Carl Kraatz defamed and libeled him with several statements Kraatz e-mailed to Gold and Silver Buyers pitchman, conservative talk show host and occasionally erratic driver Michael Berry.

  • "Wanted to let you know that you are advertising for a rapist."
  • "My best friends son worked for Gold and Silver Buyers and a girl that worked for them was drugged and raped by the owner."
  • "I know this because my friends son [name redacted] was key in the owner settling out of court for 7 million dollars."
  • [Name redacted] was dating the girl at the time and he knew that she went and had a rape test...and the results showed she was drugged and raped."

Through attorney Sanford Dow, Culwell has denied the allegations.


Culwell's suit claims that he has been defamed in writing, thus injuring his reputation and thereby exposing him to financial injury. The suit also claims that Culwell is affiliated with Gold and Silver Buyers only through marriage and that he is not an officer or director, shareholder or owner of GSB. (Gold and Silver Buyers Inc. is also listed as a plaintiff; All Phase Welding & Marine, Inc. [Kraatz's place of employment] is listed as a defendant.)

The suit seeks actual and exemplary damages with interest, legal costs, and any further relief to which Culwell and GSB can show themselves justly entitled to.

One year ago tomorrow, Culwell sued another man for defamation of character: me.

He claimed that I had disparaged him when I sent H-E-B's corporate office an e-mail apprising them of his shady past. (Gold and Silver Buyers rents space from H-E-B.) Culwell's earlier life included using the name of Hakeem Olajuwon's DreamKids foundation as a front for an allegedly fraudulent mail-order diamond jewelry business, his ownership of some reportedly shady travel sites, and a standing six-figure judgment against him that he had not yet made good.

The suit did not question me for accurately pointing out that Culwell was a thrice-convicted felon, but Culwell and his attorney (Sanford Dow again) were right about one thing. Culwell did not go to prison for the DreamKids caper. Despite a long and thorough investigation by the Harris County District Attorney's Office, that case was dropped when Culwell was convicted of felony theft in another case, one in which he defrauded an ailing old woman out of the deed to a Heights rental property. (That swindle was also the source of the outstanding civil judgment I mentioned in my e-mail to H-E-B.)

In that suit, Culwell admitted to a slightly closer affiliation with GSB. As with the Kraatz suit, Culwell denied being a GSB owner, officer or director, but did admit to being a member of a Texas limited liability corporation that had an ownership interest in GSB.

Five weeks after it was filed, Culwell and GSB pulled the suit.

Kraatz has yet to file a response to Culwell's suit.

 "I worked for gsb aka goldwiser for almost 2 years before i found out that everybody in ths company are ex cons. We were paid a salary for a unot director working 60 hours for 420 a week. The company encourages you to pay the customer as lil as 20% of what the item is worth. Since i was not paying this low amount i was let go. Brian Culwell is a scam artist Andre Lyles is an ex drug dealer Richard Scrushy is a thief and a liar as well as Jeremy Evans who is like an evil dictator and puts employees name on a wekkly email if they are not scamming the customers out of enough money to make monthly quotas."

I wonder what happened to Brian Culwell and Norman Kraatz in this case. Was the silly case even pressed forward or was it dropped or settled? And what's with the name change of Gold and Siver Buyers to Goldwiser? There is more than one way to rape people!

In order to clear my name and the good name of Gold & Silver Buyers, Gold & Silver Buyers and I have been forced to file a civil lawsuit against Norman Carl Kraatz, who has no affiliation or relationship with Gold & Silver Buyers, for defamation and libel for a series of false and reckless claims he made against me and the Company.

 

Rape is a horrific crime. We were devastated to learn that Mr. Kraatz was circulating information falsely accusing me of such an appalling act.  Rapists deserve to be prosecuted to the FULLEST extent of the law.

 

Accusing someone of rape is a very serious accusation.  I have never been charged with such a crime and the defamatory claims by Mr. Kraatz are simply untrue.  Individuals like Mr. Kraatz who make such baseless allegations should be held accountable.  Our judicial system is the appropriate venue for that accountability and we look forward to our day in court.

Love those classy Gold Digger billboards; if the above allegations are true, Mr. Culwell will be remembered as a miner with more than a gold shaft in mind. 

 

And what a shock that Michael Berry benefits from his advertising. Doesn't he advocate, along with Ron Paul, returning us two centuries back when gold coinage and reserves were so helpful to the economy?

This whole thing is just an allegation right now and could have happened to many prominent business people.

But has been pointed out, Culwell was awful stupid to stir up things by starting this lawsuit against Kraatz when it could only bring Culwell ( and Gold and Silver Buyers Inc. ) unwanted attention. Just as suing Nova-Lomax after the Houston Press expose ( and then withdrawing the suit ) was counterproductive and stupid.

Recently, people in the know have told me that GSB's advertising with Clear Channel has been cut off for non payment.

 

It's only a matter of time before this house of cards fails.Culwell will almost certainly avoid jail this time but a lot of people will be hurt.

How productive was this? If he hadn't filed this lawsuit, I never would have known he is a rapist.

@daverickey3 All of this was very predictable after the great Houston Press investigative story about Brian Culwell and his shenanigans. It's a shame that Gold and Silver Buyers or Goldwiser or whatever they call themselves, continue to steal from the public and their employees. Literally, it seems like the guy has been a one man crime wave.

@brianc123 You say never been charged with rape interesting words Mr. Culwell. Your company has come up a lot lately.  Gold and Silver Buyers or Goldwiser whatever the name your company still RIPS OFF people.  Plus what happened to the Golden Egg contest?  Does Johnny Dang know the egg was a fraud contest?

 @brianc123 Rape is a horrific crime and you should be vindicated if the allegations are untrue, But so are the crimes of swindling elderly women out of their homes. And not paying civil judgements of over a $100,000 to honorable hard working diamond people, is a terrible thing to do. How are you making out protecting yourself from those allegations in the Nova-Lomax story?

 Oh, I guess he was trying to intimidate you to pull the article. In this case, the defendant Kraat seems  like "small potatos" quoting Hyman Roth in the Godfather. Maybe Culwell really has nothing to do with Gold and Silver Buyers ( and if so, I have some oceanfront property in Arizona LOL ), but Culwell certainly has hubris and chutzpah.
