Diane Tran, Jailed Honors Student: Her Lawyer Urges Her Not to Reject Donations

Diane Tran, the straight-A student who was jailed for missing too many classes while working two jobs to support her younger brother, says she may not accept the $100,000 or so raised on her behalf, saying other kids are more needy.

Her lawyer, however, is urging her to.

"Diane has been absolutely overwhelmed by the outpouring of support on so many levels," says Brian Wice. "And while it speaks volumes about her character that she wants to earmark some of it for people she thinks are less fortunate, I think at the end of the day, the people who donated expect that money to go to her college education fund, and I will do everything in my power to see that it does."

Wice says Tran has been contacted by colleges. It's safe to assume some of them will also be offering scholarship money to the Willis High School student.

Wice met with a prosecutor and the judge who had sentenced Tran to a one-day jail term, Lanny Moriarty, and all agreed to drop contempt charge that remained on her record.

"I sat down with the judge, who is an incredibly nice guy, who cares about these kids and has done wonders with curtailing the truancy rate in Willis...and we were able to reach common ground on what is right."

Wice, for what it's worth, is extremely impressed with Tran for her maturity. She's told him she doesn't want to do a lot if interviews, something which no doubt stunned the soundbite-guru Wice to the core.

The issue with her parents was that she wasn't following their rules OR going to school for several years. They had no control and she thinks rules are for others. The family that took her in boasts about lying to get welfare. Porr Diane my rear.

Disgusted in Texas.  I respect your POV..  That said, I think youre focusing on the wrong exploitation.  George Zimmerman set up a web page, solicited money, got discount bail because he and his family lied about how much he solicited and is now in jail because he lied.  Ms. Tran NEVER asked for one dime in her defense.  This isn't fraud (nor are the Zimmerman donations for that matter).  Zimmerman (an alleged manslaughter defendant) will use every penny of his donated money to defend himself.  Ms. Tran has the RIGHT to do with her donations as she wishes.  Period.

This judge lacks common sense. Granted, a judge needs to follow the law, but not so blindly,  rigidly mechanical that he lost his common sense. The judge himself should be placed under judicial review for not seeing something obvious and offering an alternative for a better outcome.

The donors intended for her to keep it - get through her last year of HS and then go to college.  That is what she should do.  She  is obviously bright and hard working and will use it well.  Then she can help others if she likes.  She sounds like a wonderful girl.

Some things tell me this source doesn't sound right.

- If her family owned a $300,000 house, why would Diane live in her boss' house and her younger brother stays with some relatives ?- If her family had a restaurant, why would Diane have to get herself exhausted with two jobs at a dry cleaner and at a wedding planner ?- Also, if her family had a business like that, I'm sure whether her bother was qualified for a scholarship to A &M ?

From the reports I've read, she did spend a night in jail...  This guy Connelly (writer) seems to be a tad lazy..

Someoneshould really do some research on this girl! Her family owns a $300,000.00,five-bedroom, three-bath home on Lake Conroe, as well as a local restaurant andconvenience store! It is a shame that nobodytook the time to look into her or her family's past. This is credulity at itsfinest! Someone should look up Nang Tran (the father), Willis, TX and see whatyou come up with!

 I looked him up on LexisNexis. There's a $350,000 mortgage against the $300,000 house.  So what's your point?

That means that they have $300,000 in equity meaning...that house is.paid off so they can use it for whtever they want.....

By the way, if her family owns a house or a mansion, it does not mean she or her sibs could turn around and sell it for anything. I am sure the property, if there is one, is titled in the mortgage company's or the parents' names. Same is with the restaurant, if there is one, she is not the owner and she has no claim to its income.  If she own a '07 Mercedes, I pity her. It only means her parents gave her a car a while ago, now she would have to pay to keep in good shape and for which pay auto insurance. As for her brother having a scholarship at A&M, that can not support 3 people, even if he could use it for that reason. Most likely he can't.  He is better to stay in school and finish, perhaps he could support his 2 younger sisters later. If you have reason to doubt her story and question her sincerity, you should state the question plainly. Asking others to dig instead of doing the digging yourself is dirty.

The argument was never that her parents didn't have money - it was that they pretty much abandoned her.  I've known some rich parents who pretty much abandoned their kids.  The kids often still had their Izods until they grew out of them, their Walkmen & etc.  I knew one emancipated minor who worked to keep the used car she'd gotten just before her mom moved away.  It got her to work and school everyday.  Her mom would call sometimes.  Didn't mean she wasn't still shafted and finding a way to pay for her own existence.  She was tidy, prone to smiling, and since she didn't air her problems most people assumed she didn't have any.

You're making one of those, "This doesn't happen in nice neighborhoods or with nice families," assumptions.  I think research might help the news story, but I won't take what you say at face value, especially when you say, "I don't need to divulge how I KNOW for a fact what I do."

It's not Diane's place to give the money away. People donated to help her and if she doesn't want it, the money should all be returned.  Simple enough with credit card donations which most of them were.  I would be upset to see money I had given just pushed towards other causes.  My single concern is that, now with this money, the parents do not hove into view wanting a piece of the monetary action.  But I admit I did wonder why Diane needed to help her siblings when one is at university and the other was staying with relatives.  All this said, I felt it a worthy cause and I still do but it's also an evocative cause and I am sure there are many students in similar positions wondering how they can get attention for their own issues etc.

I don't need to divulge how I KNOW for a fact what I do.  I just think others should put forth a little effort into finding facts about a case before they form an opinion.  The truth will come out...it always does, and when it does this girl will be seen for what she really is, and everyone who donated money to her will look like fools.

Their home was foreclosed on, it was waterfront property valued at $360,000 and it later sold as a REO Home to a new family. Her brother (the one in college) served Pretrial Diversion in 2011 for burglary of a vehicle. The school will give consideration for excessive absences if the student notifies the school and provides proof. My sources are the Tax Appraisal District for the property, the county clerk for criminal history, and the Willis ISD student handbook regarding the absences.

I am glad that you did some 'research'...Tran is a common Vietnamese lastname so the one you found is not her dad. Before you post please ...and I mean please make sure it is right. Don't abuse the meanning of "research".

OK, I did what you asked and I got all kinds of listings for "nang tran willis tx" and none of it says anything about her family and so-call wealth. The fact is, what you said to do is like googling "Joe Smith Mesa AZ." It is pointless. Secondly, I googled "diane tran willis tx parents" and I got nothing. I imagine since the story has been out there for days, nationally and internationally, there has got to be some info on her parents... nope. So if you have anything clear and useful that you are brave enough to share, share. No need to be asking folks to do wild-goose chase.

By "sources" I meant some online info/article/link/etc.. Though, I understand where you're coming from.  But if she doesn't need the money, as you are insinuating, and she has refused to take it, then what truth can possibly come out that will make the donors look like fools?  I'm going to "assume" she has nothing to do with the donation site that collected the $ .. Anyway, you're right, the truth will eventually come out...... whatever that is.

I am not a hater, I just know how to research things before I believe them.  You would be surprised what one can find by looking into a matter.  I am not surprised she is so willing to give the money away...it is because she never needed it!
