No More Last Meal Requests on Death Row Senator Says UPDATED

The last meal should be whatever TDCJ wants, Whitmire says.
Houston State Senator John Whitmire, who wields great influence on prison issues, says he wants to do away with granting last meal requests for inmates about to be executed.

The over-the-top meal of Lawrence Brewer, executed last night for the dragging death of James Byrd, was the last straw. Whitmire wrote to the executive director of the Texas Criminal Justice Division that he had long opposed the practice, and "enough is enough."

For TDCJ to allow inmate Brewer to order...two chicken fried steaks, a triple meat bacon cheeseburger, a cheese omelet, a large bowl of fried okra, three fajitas, a pint of Blue Bell ice cream and a pound of barbecue with half a loaf of white bread is ridiculous.

"I am asking you to end this practice immediately or I am prepared to do so by statute next session," he wrote.

Whitmire said the last meal request is an "extremely inappropriate" privilege, "one which the perpetrator did not provide to their victim."

UPDATED: And TDCJ caves. A statement from Executive Director Brad Livingston:

I believe Senator Whitmire's concerns regarding the practice of allowing death row offenders to choose their last meal are valid. Effective immediately, no such accommodations will be made. They will receive the same meal served to other offenders on the unit.

I'm all for capital punishment but I don't really have a problem with them having a choice of a last meal. Maybe put a financial limit on it like some states do.

"...I'd like to go back to public hangings on the courthouse lawn...The problem with the death penalty is that we don't use it enough...You look at the criminal. If it's a dope dealer who guns down an undercover narcotics officer, then he gets the gas. If it's a drifter who rapes a three-year-old girl, drowns her by holding her little head in a mudhole, then throws her body off a bridge, then you take his life and thank God he's gone. If it's a escaped convict who breaks into a farmhouse late at night and beats and tortures an elderly couple before burning them with their house, then you strap him in a chair, hook up a few wires, pray for his soul and pull a switch. And if it's two dopeheads who gang-rape a ten-year-old girl and kick her with pointed toe cowboy boots until her jaws break then you happily, merrily, gleefully lock them in a gas chamber and listen to them squeal. It's very simple." ~Jake Brigance in A TIME TO KILL By John Grisham..         He pretty much sums it up for me there. I would only like to add that when there is DNA evidence that someone has molested a child, (or video evidence), that they also get the death penalty, regardless of whether or not a murder takes place.           Most experts agree that it's a condition that cannot be treated and cured, The rate of recidivism of offenders in this category is alarming, and often only serves to pass the sickness on to their victims. In these circumstances, It's my opinion that these people also be put to death, but only after they've navigated the justice system, which gives them a ridiculously long time to prove their innocence through science or other methods. JMO.

Here's a thought.  Execution is such a wasted life.  It contributes nothing to society.  Instead of scurrying the DR inmate to the chair or the table, send them instead to a life in the lab.  Right now our new drugs are being tested on rats.  I don't know about you but the last time I checked, the human body bears very little in common with a rat.  The DR inmate is a great person to test to find cures for the world's most elusive and incurable diseases.  Their lives could be used to save lives.  Some might say that's cruel and unusual punishment.  So is running lethal drugs in your veins or electrocution.  At least they can give something back to society before they die.

They could do that while they are dragging out their appeals process. The best of both worlds.

Oh, and cruel and unusual punishment is what they inflicted on their victims.

How sad. How sad that Whitmire is such a vindictive, small-minded person to not allow one last bit of human kindness to the individual about to be murdered. And, I bet he goes to Church at least once a week, and considers himself a kind, loving, Christian. How sad the Face of God he sees is as small and vindictive as his face. Perhaps he looks in the mirror and thinks he sees God?

My2Cents

oh yeah that last bit of human kindness, wonder if the one about to die bothered to show that last bit to their victim....  I say send his ass to hell hungry

Keep it simple stupid.  After years on death row all I'd want as my last meal is a heaping helping of pussy, with a big side of tossed salad.

I'm a conservative Canadian and (which is unusual here) think capital punishment has its place, depending on the severity of the crime. But this is gratuitous and disgusting. As are the comments here by those who think a single meal by someone about to die is another example (yawn) of liberal mollycoddlying. The "liberal" comments aren't much better, and miss the point entirely.

The last meal is a custom historically observed by even the most primitive, barbaric nations. Practically, it acts to calm the condemned down before meeting his maker - which is in the state's interest if it wants to avoid public revulsion.More to the point, though, it is at least a gesture of recognition that the condemned (no matter his crime) is human, that he's to be put to death, and that even the worst among us deserve that recognition. It's comparable to a clergyman's pre-execution ministry, attempt at consolation, and prayer with the condemned. Would you do away with that, too?You all are one mean-spirited lot down in Texas. Up here in Canada, we don't mix religion and politics much, or at all, but you folks do. You really think this sort of stuff is What Jesus Would Do? If so - I really would like to know - why, and how can you justify it with reference to Scripture?

Look to the state of your souls, tough guys.

The doomed get a meal, what everyone else in the hell hole gets. They just don't get to make any special requests for stuff most people in the states can't afford. Jesus would likely just rip out a murderers arm and beat him to death with the wet end like the kick-ass god he is.

Forum2011

What bible are you reading?  The one I have doesn't mention Jesus kicking anyone's ass - much less ripping people's arms off.

Richard Gaul

The "doomed" aren't doomed by God. They're doomed by an imperfect system of justice that professes to be based on "kick-ass" Christian principles.

These guys' sentences aren't really like those of their fellow prisoners, are they? And these "special requests", again, are rooted in long, well-justified custom. Thought you conservative Texans had a lot of time for tradition.

Seems to me you all just want to piss all over a guy about to meet his maker, that hated Big Government is about to rub out. Pissing, naturally, from a safe distance. And by removing his last, meagre pleasure.

Nice.

True, it reads too long. Paragraphing screw-up.

How about this: it's a mean, crappy gesture to which no civilized society should stoop. All it shows is a puniness and lack of Christian charity. I don't remember seeing like this garbage in any of the great Westerns, if that means anything.

I think instead of executing them, the food provided in the last meal should be highly spiced with poison....

You fool of a sick man, The purpose of the criminal justice system is to show them that we are not like them. an eye for an eye makes the whole world blind, but how long until a man born blind punches you in the face?

Actually the purpose of the criminal justice system is to punish people for doing wrong. By the way, I'm not blind. Are you blind? No? So what you stated is a lie? Yes, it is.

Can I at least have dessert. I PROMISE YOU WILL NEVER HEAR ME COMPLAIN ABOUT MY WEIGHT AGAIN! Whats is eating everybody today? Insults for expressing your own opinion? Hmmm, well maybe not eating EVERYBODY but who the hell could stomach a meal moments before death? Give me my nerve pill ( like they do) and shut the hell up.

Troy Davis didn't eat any dinner or take the Atavan offered to him.  This State Senator is just mean-spirited.  Or maybe he was hungry when he made his statement!

"One which the perpetrator did not provide to their victim".  Exactly.

However, aren't we supposed to be better than a murderer?  You know "civilized society".

Oh, it's Texas.  Sorry, carry on.

Murder has to do with intent.  I can say that the intent is punishment, revenge.  I would say if an individual carried out such an act, ever how pristine and controlled the environment of the killing scene, it would be deemed murder.

Laura_RT
Laura_RT

Yeah, let's all just decide that words mean what we want them regardless of what has previously been agreed upon by society.

Dohutch

I'm not speaking legally.  That's what the Supreme Court, the GA Board of Appeals and all the rest who let Troy Davis die without the chance to determine the truth of his case last night were doing.  That's why he's dead now.  There's no room for any kind of compassion in a system that washes its hands of such a doubtful case and chalks it up to legality.  A man died.  Someone killed him.  I was using the dictionary to make a point.  It's time to talk straight and call things what they are and certainly killing Troy Davis was not justifiable because the facts were not clear, regardless of what you believe about the death penalty.

Laura_RT
Laura_RT

The dictionary DEFINES murder as illegal.

Kristine

Was it his (Troy Davis's) mother who said "He believed his own lies?"

Ian Rennie

whether you are speaking legally or not, to count homicide as being the same as murder you would have to count every ending of life, from calculated murder to self defense to traffic accident, as murder.

The executions carried out last night were, by my personal morals, entirely wrong.  I think the example of the rest of the developed world has shown it is possible to protect the  innocent and punish wrongdoers without state sanctioned killing.  We can say all this without invoking murder, in my opinion.
