Jamie Leigh Jones Rape Suit: Jury Rules in Favor of KBR

Categories: Courts

jamieleighjones070811.jpg
Jamie Leigh Jones had a long wait for her day in court.
A federal jury rejected claims by Jamie Leigh Jones, who says she was gang-raped as a KBR employee in Iraq and then mistreated by the company.

The jury found she was not raped, and KBR did not commit fraud.

Jones, 26, sued KBR/Halliburton over what happened in July 2005 in Baghdad, saying she had been given a date-rape drug and then raped by several men. She said KBR confined her to a shipping container after the incident, with minimal bread and food provided.

Jones's attorney, Ron Estefan, told the jury in final arguments that she should be awarded as much as five percent of KBR's net worth in actual or punitive damages, a figure which could be over $100 million.

KBR's attorneys told the jury Jones's story was not true.

"I am asking you to reject that fiction," KBR defense lawyer Joanne Vorpahl told jurors in closing statements.

KBR fought the suit by saying that Jones's employment contract required arbitration, a claim that resulted in Minnesota Senator Al Franken leading a fight to ensure defense contractors could not have mandatory arbitration clauses in their contracts.

Jones also testified before Congress, and started an organization called The Jamie Leigh Foundation, which helps crime victims.

Welcome to america. I hate this country and feel less a citizen each day. We're controlled by corrupt politicians and judges whom are purchased by big corporations. It's a puppet system and they can buy anyone. Rape for example, is perfectly acceptable as long as you have the funds to back it up. Bottom line, if you have enough money you can get away with anything. The saddest part is that 90% of Americans are oblivious to what their politicians are really up to. They'll just keep voting them in and keep blindly supporting individuals who would sell them out in the blink of an eye. We no longer have liberties in this country and next to no corporate official can be trusted.

Of course the jury ruled in favor of kbr. That's a no brainer. They were all bribed. That's the american way.

These big corporations run our country. All the head honchos at KBR should be dragged into the street, beaten, mauled, burned alive and then hung in front of their families.

Innocent until proven guilty, that's how the system works. The jury has to go for "not guilty" at the slightest shadow of a doubt. That's how the system works. Some people commenting here need a little refreshment over how the US system works, because clearly some people don't care about evidence or doubts or similar, they are willing to take a sob story at face value without any critical thought.

Americans, you're sometimes so gullible and stupid it's amazing your country is still around.

The verdict was not a surprise to me in the end, given how much came out against this woman's story. In the beginning I was fully in support of her, as I despise and distrust Halliburton. However, such were the inconsistencies and deliberate lies she told that I have to admit that this company suffered a grave injustice. Consider the fact that Ms. Jones's planned book,  'The Jamie Leigh Story: How my Rape in Iraq and Cover-up Made Me a Crusader for Justice' for which she sold the film rights in 2008, was the subject of interest to the defence lawyers who Jones refused to provide as she claimed it would diminish its value. In fact, her own lawyers filed a motion declaring that it was actually a work of fiction. As today's article in Mother Jones (no relation) puts it:"At the same time Jones was telling therapists and psychiatrists that she was virtually disabled by post-traumatic stress disorder and could not work, leave the house, drive, or have meaningful relationships with men, she has completed three college degrees, including an MBA; gotten married; had two babies; worked as a teacher and now as a part-time college professor; testified repeatedly before Congress; gone on TV; appeared in a documentary; and started a foundation to support women working as contractors overseas. It's not the résumé of someone as paralysed by trauma as Jones has claimed to various therapists and psychologists."www.tracesofevil.com

You have no idea what you're talking about.  Jamie Leigh Jones was raped--no contest.  Bortz has a history of sexual assault.  Jamie was drugged and is now being punished for not remembering the ordeal.  But when you wake up bruised and battered, and penetrated vaginally and anally with no knowedge, and a man is still in you room telling you you had sex you don't remember, there is nothing consensual about that--I call that rape.

As Mabe said, the testimony shows that the woman wasn't truthful.

I think you need to review the testimony, you have no idea what you're babbling on about.

It is hard unless you were there to see the 11 defendants attorneys against Mrs Jones and her 2 attorneys for people to make assumptions and people to bend the truth to make it fit one way is impartial truth has it right cheetah has it wrong nofanojones yes shame on Jamie Jones for making it possible for criminals to be held accountable by extending MIJA to make jurisdiction for future victims Shame on us for not recogzing it sooner to protect her why do you think there was no criminal prosecutions in iraq of civilians for so long cause everyone that worked there under contract were angels until 2010 when that law passed shame on her for overturning arbitration to hold her company accountable unfortunately  the number of assault victims known to be a result of the company will not be known due to  gag order you will never hear about due to arbitration to fight six years and never give up being on the front line of citizen rights the people against her will be the quickest to utilize the rights she has helped maintain for them Shame on all us small people if only we could help ourselves as much as she has helped us

having been to Iraq many times myself and seeing first hand how the females behave once they get there i would deduce that it was "play time" until it came time to pay the piper, or in the case of most female soldiers, hubby finds out she was being a slut and then its "ohh baby i was raped"...not saying that the men aren't responsible as well because they are idiots for playing into it...but i have personally witnessed females playing the "hoe roll" (charging for sex) getting busted and crying rape because that's easier than taking responsibility for being a hoe. the worst part about it is that 90% of rape cases are made up..leaving the 10% of real victims hardly any chance for justice......just sayin. do i think she is lying? i'm 99% sure something happened to her over there, was she a rape victim? i think she was playing with fire and got burned.....

Who considers having their implants punctured and their pectoral muscles torn as a "good time"? The fact that there is a rape kit at all kind of proves that this wasn't a case of someone just getting caught by the hubby.

Let me call BS on the 40 others and I am not KBR and have nothing to do with the case -- I watched and listened and came to my own conclusions.  I do believe the USA has jurisdiction over a US citizen working for a US company -- sorry -- you are wrong there.  Keeping spinning and spinning -- it ain't working.

First of all KBR/cheetahkitty you did NOT get the above information you wrote of from simply sitting in that courtroom!!!! Shame on you! Secondly, it did NOT have jurisdiction in 2005 but it certainly does have jurisdiction NOW, thanks to Ms Jones!!! And last, for you to call FORTY other rape victims BS is disgusting and shows your true character!!!! May God have mercy upon your soul! Goodbye, I no longer will address your ignorance!

God!!! - Why are all you ''people'' (translation: feminist liberal democrats) on this woman's side!!! She MADE IT UP!!!If HALF of what was put out there about some of her previous sexual liasons (she wasn't even MARRIED!!!) are true I wouldn't believe a WORD she said.I studied this case. She didn't even have any CIRCUMSTANTIAL evidence and ZERO witnesses!!!Jamie Leigh Jones DOES, however, have a history of being sexually active BEFORE being married and a history of LYING. Oh, also a history (by her OWN ADMISSION) of mental illness.VERY credible. /Sarcasm/If I were the corporation, I would now COUNTER-Sue her for time lost, defamation of character - whatever I could think of and just really mess her life up. One more thing Jo, did you wish to discuss how KBR PAID for Charles Bortz's attorney and ALL the "so-called witnesses"? Does that sound like an innocent company? NO!!!! SO KBR has TWO employees and pays for the accused rapist defense!!! DISGUSTING!!!! AND Bortz is the repeated offender...remember his two arrests for assaulting two other women AFTER what he did to Ms. Jones???!!!! You KNOW thats true, for others who didnt realize, google Charles Bortz mugshot and you will get to see his mugshots and yes IT IS THE TRUTH,  I was in court and heard Bortz's attorney drop his "slander accusation" against Ms. Jones so that the jury would never be able to hear how he assaulted two other women!!! Too bad the jury didnt hear that or you are right Jo, it would of been a matter of minutes instead of TEN HOURS and they would of reached the right decision instead but since they never had ALL the information against KBR and Bortz.....we shall never know

cheetahkitty
cheetahkitty

Maybe the judge should have let in evidence that she had also falsely accused her former boyfriend of rape when she was 17 years old and that the KBR guy wasn't indicted, the jury would have found against her in a matter of minutes rather than hours -- former KBR employee was never indicted and has never been accused of rape.  She, on the other hand, is a serial victim, having cried rape at least four times with three different men.

Obviously ignorance is easily spread and it sounds like you believe the press too! Because we all know the press is ALWAYS accurate! WRONG!  I suppose you believe everything you read too, right?!?!?

I can only hope that not all of this case is lies. If she did lie about this then justice was served, but what's scarier is, what if she didn't lie? I still believe after hearing both sides that there are holes in both cases. So although I'm not going to personally say who is right, because I don't know, the implications on either side are very drastic, and I just hope that one day the truth of the case does come to light. I just hope that it does not deter any person with claims of sexual assault of abuse from coming forward. If anyone was harmed I feel the public needs to be made aware of the attackers, and don't let this one case stop you from attempting to bring justice to the ones that harmed you.

Truth
Truth

maybe if the judge would of let in hisTWO OTHER ARRESTS for ASSAULTING TWO OTHER WOMEN and all the other information, the jury could have made the right decision instead....

nofanofjones
nofanofjones

Problem with a trial is that both sides get to produce evidence.  Jones has been promoting herself and her fiction for years -- once KBR got to tell its side of the story, the truth came out, which was this:  she falsely accused a man of rape.  Shame on her and what she has done to women or men who have legitimate claims of rape.  She has totally trivialized other claims of rape by her relentless self promotion and promotion of claims she should have known would be proven false.

Truth
Truth

wow there are a lot of ignorant statements there and I guessing from those comments of yours that you base your "knowledge" from the press and that you never stepped foot into the courtroom because if you had, you would know the REAL truth and had heard all the evidence that was not allowed in...maybe if the judge would of let in his TWO OTHER ARRESTS for ASSAULTING TWO OTHER WOMEN and all the other information, the jury could have made the right decision instead....

cheetahkitty
cheetahkitty

I saw her testify, I saw Bortz testify, I saw some of the experts and family members -- she was not telling the truth and repeatedly was confronted with her lies and distortions.  Sorry, but she is as sorry as one can get -- she falsely accused a man of rape, in fact, it seems she's falsely accused three men of rape -- She is a self promoter of the worst kind.

"Truth," please stop. Mdk is right.I am going to ask the Houston Press editors to suppress any further replies from "Truth" that do not sufficiently acknowledge the court papers. Any further replies from "Truth" need to link to specific documentation from the USDOJ, and have specific commentary so people know that "Truth" has sufficiently looked at the documents.

See, now that the jury found KBR innocent, the people who say "KBR is innocent" or "there is no proof" don't have to work as hard as the people who say "there's a conspiracy!"

Truth,

Did you get the chance to read the State Department interviews/findings in this case? Hard to argue that DOJ should have pursued criminal charges against Bortz when one of the foundations of her claim, that of rape by multiple assailants, is explicitly and thourougly disproven. As for her "detainment" in a shipping container--she was in a VIP CONTAINERized housing unit for a matter of hours. After witnessing much of this case, her pattern of behavior is consistent with that of a pathological liar, and it's impossible to give her the benefit of the doubt.
