Fifteen-Year-Old Bride Detained After Fracas in Corpus Walmart

Old enough to marry and get arrested in a Walmart
An 18-year-old man, his 15-year-old wife and a 19-year-old friend of the couple were jailed in Corpus Christi after a fight with store security at a Walmart.

According to the Corpus Christi Caller-Times, a rent-a-cop confronted the trio after seeing them allegedly swipe clothing. At that point, Michael Anthony Del Toro, the 18-year-old husband of the bride-not-old-enough-to-drive, slugged the 55-year-old security guard in the face and put him in a chokehold.

According to reports, the two females with Del Toro also "became combative." An off-duty Corpus cop happened to be on the scene, and he reported that he identified himself and tried to break up the melee, but Del Toro did not turn the security guard loose until he was pried off by still more cops.

Once the dust had settled, each of the females was charged with misdemeanor counts of suspicion of interfering with a public servant.

For his part, Del Toro was hit with a felony charge of aggravated assault of a security officer and also a misdemeanor for the pot he was allegedly carrying around with him while allegedly shoplifting in Walmart. (That's really dumb -- he should have had his wife hold that weed for him -- everybody knows kids get a slap on the wrist for drug charges. That's why dealers use ten-year-olds as their couriers on the corner.)

The age of legal consent with parental permission in Texas is 15. I know, I had a cousin that got married when he was 17 and she was 15. Fortunately they didn't shop lift at Walmart, though they were white trash in all other respects. (lived in a mobile home, own numerous semi functional vehicles, drove a motorcycle as the primary vehicle, had over 6 dogs, etc)

I was pulling the 16 age limit out of a 2005 Family Law Code I have sitting in my room. At that time - that is, 2005 - it says the age had just been raised from 15 to 16.In theory, I suppose they might have lowered it again. To know for sure,. we'd have to find someone with, you know, a Family Code written this decade...

I know this is almost beside the point when you’re dealing with a brain trust like Del Toro & Co. here, but you’re not supposed to be able to get married at 15 in Texas.

The age is supposed to be 18. A parent can give consent to marriage for the kid if s/he is 16 or older – and if a parent gives consent before that, it’s a 3rd degree felony.

So there might be something a little hinky going on here…

Your understanding seems to be at odds with the actual Texas Family Code, which says a parent is guilty of a felony if they consent to a child under 16 getting married..My reading of it is that parents would have the POWER to consent to marriages below 16 but would be committing a felony in doing so. (No parent is ever going to consent to a child 16 or younger getting married unless there's a pregnancy involved, of course, and that would make a DA more unlikely to pursue charges...)My suspicion, however, is that the situation at hand involves a guy who was just calling his underage girlfriend his wife, so it should not take away from your enjoyment of the Walmart brawl at issue here...People of Walmart are people of Walmart... Never forget that...
