The incident, in which an unnamed victim died of blunt-force trauma after being hit in the head with a rifle, is being referred to a Harris County grand jury.
Police say a group of people were drinking about 1:30 a.m. Saturday in the 14500 block of the Hempstead Highway when an argument began.
Police say the victim went to his car and came back with a screwdriver, continuing the argument. Another person got a rifle. A third person who was trying to keep the peace took the rifle and "struck the victim in the head with the rifle to keep him from stabbing the person the victim was fighting with," police said.
The man called 911 and waited for police to arrive. He has not been charged and the investigation is continuing.
