• To the Editor: Dr. Rothenberg was assured by medical experts this was the same Botox from the same source as the Allergan Corp which apparently holds a monopoly and whose cost of goods is about $5 but sells it to doctors for $500! To seek it from the wholesaler seemed a good idea at the time. "NOT FOR HUMAN USE" can be found on many products at any beauty supply shop in Houston. Everyone seems to get the basic facts of this case wrong. Greed was not a factor! Botox treated the doctors like any monopoly would - with arbitrary price increases. Let's not forget NO ONE WAS HURT! At the trial it was proven it was as safe as Botox - if not safer. The trial evidence showed everyone got satisfactory results! This is a case where a huge corporation paid the FDA untold millions and wanted their money's worth back. There is a back story: The FDA was unsuccessful in stopping "Botox" (licensed by the company) from Canada, Mexico, China, etc. This ironically is legal. But just because China paid to use the name "Botox" is no guarantee it was the same as that sold in the U.S. So why not crack down on this scam? Because the Botox company, who was paid to protect this non-FDA approved "Botox" paid the FDA to protect its name - not the patients - its own Botox name. The record is very clear that a) the company that sold this substance was openly doing business in the U.S. for at least a year - where was the FDA? Why didn't they shut them down and warn doctors or their exposure? And b) Dr. Rothenberg was assured by other doctors who had been using it for a year that it was the same. I need not go into all the ways medical spas cheat their Botox patients - and how many don't know what they are doing. Dr. Rothnebrg would never intentionally jeopardize her patients or her career had she known it wasn't the same. She was not only good with injections, she was the best in Houston! It was never about greed. It was a stupid attempt to fight corporate America. If anyone was hurt, there are the civil courts to resolve this. If people felt cheated, it would have been easier to pay back the $100,000 to them immediately than pay her legal fees (and her medical license). Q: How did this become a federal criminal case? A: Because almost anything you do - including copying someone else's music is a federal crime. If they want to make you an example, if they seek you out, if the industry wants to prosecute you as warning, you'll find yourself in federal court and demonized in the press. Shame on you Houston Press. You usually show great insight into the real facts. You just followed the herd on this one. Allie White
