City Council once again delayed the vote on extending BARC Interim Chief Gerry Fusco's contract today, possibly killing any chance to revive the vote in the future. Fusco's initial agreement with the city, made possible via a $49,500 purchase order, expires Friday.

Health and Human Services spokeswoman Kathy Barton, who was at the meeting, said she's not sure yet what effect the delay will have on retaining Fusco's services.

After weeks of delays, Council was expected to vote -- and approve -- the contract today; Councilwoman Jolanda Jones tagged the item, saying crucial questions she raised two weeks ago still haven't answered.

The move sparked a contentious debate over whether to override her tag -- a rare Council procedure requiring ten votes. Some council members indirectly accused Jones of strategically tagging the vote to sink the contract, and not for legitimate purposes. (Jones also said she received word that Fusco said he would quit if the council didn't approve the contract today, which she described as a "tantrum." Hair Balls hasn't been able to confirm said tantrum, and whether or not it involved the holding of breath and/or stomping of feet).

 

Voting to override the tag were Mayor Bill White and council members Sue Lovell, Anne Clutterbuck, M.J. Kahn, Mike Sullivan, Pam Holm, Peter Brown, Toni Lawrence, and Melissa Noreiga.

Council members Wanda Adams, Ed Gonzalez, Ron Green, James Rodriguez voted to sustain the tag. Councilman Jarvis Johnson was present at the meeting but absent for the vote.

In a discussion in which the brandishing of firearms was narrowly avoided, Jones said Fusco had declined to answer some key questions during an August 21 meeting between the two, and, knowing she would miss the August 25 council meeting, she e-mailed those concerns to White that day. Specifically, Jones cited a lack of concrete benchmarks in Fusco's contract, which lists broad goals like increasing adoptions, but has no set numbers or percentages by which to definitively measure progress. (Prompting palpitations in Hair Balls's heart, White curiously described the contract as among the "most detailed" of any city contract). 

Jones missed the August 25 council meeting because she was climbing a mountain in Colorado as part of a "leadership forum," prompting a dig by Lawrence, who asked rhetorically why Jones had to miss the meeting. "Was it city business, or was it not?" Lawrence said.

In a move to get Jones to remove her tag, Clutterback asked Elena Marks, White's health director, to answer Jones's questions. When Jones barely registered Marks's presence, Clutterbuck said she was "baffled" by her colleague, who, Clutterbuck said, "gave me her word" that she wanted to ask Marks direct questions.

UPDATE: We just got word that Fusco said he will stick around through the next council vote, which is September 16. (We got this from a volunteer who forwarded us an e-mail from Health and Human Services Director Stephen Williams, because it'd just be stupid for someone from the city to actually tell us what's going on).

Yesterday Ms. Jones was all over the room, strutting like a rooster...and talking to everyone.. she knew today was important, and she failed miserably to substantiate
her issue of not getting answers from Mr. Fusco. Knowing this was a potential issue, Elana Marks came to the meeting to answer this woman's questions.. after all, would Ms. Jones even have believed Mr.Fusco had
he answered her questions? NO,she would have
wanted it in writing. So what was the point?
To create more havoc, and see more animals killed. She is 'at large' so all of Houston votes for her re election....
She has really 'screwed the pooch' this time!~ Sorry Mr. Fusco.. you deserve better. And so do those precious animals waiting for the gas chamber~

I am almost at a loss for words, but not quite. I am very disappointed that Jolanda did this but do understand why. It was a tactical maneuver to kill the vote. She was voting no, and I am sure she had figured out that there were enough yes votes that she couldn't stop it. Once again Houston has failed the most vulnerable animals in the city. WTF does it take to provide appropriate compassionate care for animals in this town? I actually saw an email on one of the yahoo groups bitching about who cares if BARC is cleaner aren't they still killing animals? What does it take to connect the dots? Lack of cleanliness leads to sickness and death at BARC. Why do we think they had such an epidemic of distemper there? Too many people have no ability to see the big picture here.

Perhaps Jolanda Jones and those who voted to sustain the tag were not in as much of a hurry to see this annoing matter of BARC go away. Animals don't vote and time spent on their control, abuse, and extermination could be better invested in high profile people issues, right? I for one wish to commend Ms. Jones for being a pain, a joke... but above all for being perspicacious enough (unlike defenders of Fusco) to recognize a flim flam consultant when she sees one. Thanks are also in order for Council Members Adams, Gonzalez, Rodriguez, and Green who are willing to look at Fusco with the magnifying lense that his lack of transparency requires.

At least Council Member Jones took the time to meet with Fusco and had questions to ask about the contract. She is doing what she is elected to do- make informed decions on behalf of Houstonians. Do you really want council members that just blindly follow the mayor into a fire?

If Fusco wants to contract with a government agency then he needs to make damn sure that he answers questions that are asked of him by a member of council.

This is a much divided issue. There are some who are very opposed to Mr. Fusco. I don't think he was the best choice for the job, however I most likely would have not been as vocal in my opposition if the $49,500 purchase order hadn't been snuck through without city council vote; and if Fusco's contract had more concrete goals and timelines i.e. instead of "increase adoptions", it should say "increase adoptions by X number of animals by X date" etc.; if there had been more specific wording regarding the consequences if benchmarks or goals weren't met; and if he would just answer Councilmember Jones' questions. We’ve been complaining about a lack of transparency at BARC for years. How about a little bit of transparency from Mr. Fusco? What’s wrong with that? I don’t understand why some are willing to follow blindly without even getting basic questions answered to ENSURE that Mr. Fusco’s does what everyone prays he can do which is stop the killing. I don’t understand criticizing a councilmember who is asking hard questions to insure that BARC animals get what they deserve this time. If Mr. Fusco truly cares, as he has claimed and we would hope, then he will wait 2 weeks until council can vote on this again. (Hopefully, in that time, he will answer Ms. Jones' questions) It’s not like he hasn’t been paid anything at all. Williams paid him $49,500 just 5 weeks ago. That’s more than a lot of Houstonians make in an entire year. I don't think it's unreasonable to wait 2 weeks for the next paycheck.

Why is it that when people disagree we have to be so extremely negative and nasty? Why do people say things like "strutting like a peacock" "house negro" etc. Does this type of talk help the animals? NO, THEY CONTINUE TO BE ABUSED AND KILLED AT BARC as LONG AS THERE IS NO LONG TERM PLAN AND BILL WHITE CONTINUES TO BE THE MAYOR. I agree with no kill's comment: - Elmo's comment should be removed. The remark is EXTREMELY offensive.

In regards to the first comment, the poster is referring to the recent contretemps over Jones's quoting, in a public forum, someone who had called an official of a Houston firefighters' union a "House Negro."

We assume the commenter's point is that Jones is known for grandstanding, or something like that, but we don't want to put words in anyone's mouth.

At any rate, since the comment refers to a recent (if possibly irrelevant) well-reported incident, and is not simply calling Jones by that term, we're going to let it stand.

We're not endorsing it or anything, but there are a lot of comments we don't endorse but nevertheless let stand.

Thank you NO KILL HOUSTON and I DON'T UNDERSTAND for calling people on racist and ugly remarks. I am at work so zipping through and typing fast. I saw it but didn't call it. I appreciate you. Gerry Fusco is going to stay on without pay for the next 2 weeks while council decides what to do. Open your eyes people. The morale at BARC has improved dramatically since he got there. Good changes ARE underway. Isn't that what we wanted from the get go. I agree I wish the initial contracting with him had been done differently and certainly it didn't help for the city to poor mouth and get small animal rescues to pay for Winograd then turn around and pay for this. But it is what it is. I think Gerry is doing a good job and the city controller who I have great respect for supports this contract being approved. I also happen to adore Jolanda but I had no problem emailing her this afternoon and respectfully disagreeing with her.

Quit with the racist comments and take care of business. Bottom line on the "house negro" is that Jones, herself, said it, period. While she's done good work, she also grand stands. When I first read it, that was my first assumption - that it was a reference to her grand standing - NOT racist. Get over the "racist" comments to everything. We are ALL humans and the ANIMALS at BARC need HUMAN HELP.

If Elmore would spendess time attacking people and MORE time trying to figure out how to convince council to double BARC's budget for FY2010, everyone could go home happy (well maybe not the animal haters). It has Never mattered whether you were for or against Fusco, BARC's budget sets ANY DIRECTOR UP FOR FAILURE! Its a no win sitution.

Regarding my previous comment: It just goes to show how little people know about their council people and how little they pay attention to the news. Jolanda called the head of the HFD union that racist epithet. It was a big story. I found it offensive and despicable, as I do most of Ms Jones' actions. She is not someone worthy of respect, and she proves that point today by sabotaging the mayor and council's efforts to improve BARC.

I hope that those posting and reading these comments will take the time to learn more about the zip codes which are the largest "contributors" of animals to BARC from January 2003 to June 2009 per the City of Houston. The top (401 to 550 cats/yr) contributors of cats are 77072, 77036,77099, 77096, 77023, and 77017. The top (1201-1500/yr) contributors of dogs are 77093, 77016, 77026, and 77033. Don't use the info to start a blame game. Use the info to start working on solutions. How can each person team up with organizations or other individuals to reduce the numbers of animals BARC is asked to take in each year?

Good suggestion concerned volunteer. Wouldn't it be great if everyone would work on being part of the solution? Most companies nowadays don't let you just walk in and complain about stuff at work. You are expected to have solutions in mind.
